No, you do not need to be present, but our photographer will need access to the property. We highly recommend that you walk through the property prior to the photoshoot to make sure it is ready to be photographed. De-cluttering the home is the responsibility of the property owner. If you have specific shot requests, please communicate those to the photographer before the photoshoot.

With over 240,000 photos delivered to NC agents 2021, the rule of thumb is about 1% of the square footage (i.e., 3500 sqft = 35 photos). This gives you the optimal number without causing viewer hunger (too little) or fatigue (too many). The exact number may differ because of floor plan, furniture layout, staging and available angles.

You will receive an email once your order is completed. This delivery email will contain links to your order and your user name and password to your online account where you will find all your marketing downloads. All images are delivered in 2 different sizes (Print, MLS). Videos will be in 5 different resolutions in the Marketing Kit under Flyers, Printable Materials and Attachments.

Zillow walkthrough videos are uploaded directly to Zillow.com by us and will appear in Zillow once the listing is active.

You can download your images using the download photos link on the completion email or you can login to you account and find the under the Marketing Kit, Download section. Just click the button to access your download page. When you download images, you can choose from pre-set sizes that include print quality and other web-optimized sizes. You can also type in any dimensions that you want and the image(s) will be resized to your specifics. Your high-quality images remain in your Mark Jacobs Production account to use whenever you want.

Agents should use the Unbranded website link in the tour field in the MLS. This link can be found on your deliver email under Website Links, Unbranded Property Site or in your account under the Marketing Kit tab, Website Links, Unbranded for the MLS.

branded and unbranded website links are created for you and your client to use for marketing purposes.  Whether using them on social media sites or in email marketing, using these links will take viewers directly to the property site that has been created.

How to get the website links

Step-by-step:

Step 1: From the Sites tab at the top of the page, click on the property that you need to access the links for.  This will take you to the Site Summary.

Step 2: Click on the Marketing Kit tab on the left-hand side.

Step 3: In the Website Links section, you will see short and long links for both the Branded and Unbranded versions of the property site.  Both the long and short links will display the same property site for the corresponding link type.

Step 4: If any links have been added to the Site Media tab, such as video or 3D links, these will be displayed in the Special Links section.  You can copy the URL or access the embed code by clicking the "Embed Code" button.

To take your site offline go to the Site Activation tab and click the GO button under Offline. 

Once you select the GO button under Offline, the site will not be active again until you re-activate the site.

You can also select the GO button under Pending and Sold to move the site to these status also. Once the property is sold you will need to move the site to Archived to remove it from your account. 

To rearrange your photos go to the Site Media tab, click and drag the photo to the desired location. 

You can hide a photo by clicking the eyeball icon on the photo. This will hide the photo from displaying. 

Step-by-step:

Step 1: From the Sites tab at the top of the page, click on the property that you would like to edit the information for.  This will take you to the Site Summary page.

Step 2: Click on the Site Data tab on the left-hand side of the page.

Step 3: In the Listing Info section, enter in the MLS number, Listing Price, and a Special Marking for the site (if needed).  

Step 4: In the Property Description section, enter in a property description for the home.  You can also enter in Key Words for search engine optimization.

Step 5: In the Property Features section, you can enter in the beds/baths, square footage, lot size, and a few other details.  By default, we include a School Website and Local Demographics Website that will be displayed for potential buyers.  You can change these default links if you would like.

Step 6: In the Noteworthy Amenities section, list out amenities that come with the home.  These will be displayed on the site in the order that you enter them.

Step 7: If needed, you can move the map pin to the proper location. Note: the property address is locked in after 30 days.  If there is an error and you need it corrected, please contact us and we are happy to take care of this for you.

Step 8: If needed, you can also change the Site Attribution that will display on the property site.  For example, you can have your photographers name displayed here instead of your business name.

Step 9: Scroll to the bottom of the page and click "Save Changes".

Step-by-step:

Step 1: From the Sites tab at the top of the page, click on the property that you would like to change the Site Design for.  This will take you to the Site Summary page.

Step 2: Click the Site Design tab on the left-hand side of the page.

Step 3: In the Website Design section, click the "Select Design Style" button.

Step 4: On the left-hand side, choose the Design Style Series that you would like to use for the property site.

Step 5: In the drop-down menu that appears, select the Series color that you would like to use.  Clicking on a series color will give you a preview of what the site will look like with that color selected. Note: You can scroll down in the preview box to view the whole site in the selected color.

Step 6: Once you have chosen your series and color, click the "Ok" button.

Step 7: If you click "Adjust Design Settings", you can make changes to certain items of the site design.

Step 8: Make any necessary changes such as fonts, navigation names, or the speed of the photos.

Step 9: Once your changes have been made, click "Ok" to save them.

Step 10: To preview the site and any changes that you made, click the "Open Preview" button.

To change the links to the school and demographics websites you will need to go to the Site Data tab then under Property Features you will see the links to these fields. They will be marked as Link Type Standard. Click on the down arrow to the right and you will be able select Custom to add you own link or you can select Disable it and it will not show on the property site.

Step 1) Select the site tab from the top of the page, click on the property that you would like to change. This will take your to the site summery page

Step2) Click on the Site Design tab on the left-hand side of the page.

Step 3) At the bottom of the page select Background Music. Pick the music you would like and save.

Step 1: From the Sites tab at the top of the page, click the property that you would like to access the Site Videos for.  This will take you to the Site Summary page.

Step 2: Click on the Marketing Tab on the left-hand side of the page.

Step 3: Scroll down to the Site Videos section to see the Teaser, Branded, and Unbranded videos. 

Step 4: If you need to make any changes to the video, click the "Edit" button.  Make your changes and then click "Save Updates".

Step 5: If you have chosen to make changes, you will want to click the "Rebuild" button to ensure that the video reflects those updates.

Step 6: Once the rebuild is complete, click the "Download MP4" button.  For the Branded and Unbranded videos, you can also view it on YouTube or copy the YouTube embed code.  You can then share the video out however you desire.

You can find your measurements and Floor Plan by logging into your account. Go to Site Media tab on the left side. You will find your measurements under Site Attachments and the Floor Plan under Floor Plan. You can also find the at the bottom of the Download Page.

When you upload a floor plan to your clients property site, you can include hot spots on the floor plan.  These hot spots, when clicked on, will take the viewer directly to the photos for that specific room.  This will allow them to get an even better idea of the layout of the home and understand which photos belong to which room.

Step 1: Click on the Sites tab at the top of the page and search for the property that you need to add a floor plan with hot spots to.

Step 2: Click on the property from the search results.  This will take you to the Site Summary page.

Step 3: Click on the Site Media tab on the left-hand side of the page.

Step 4: Scroll down to the Floor Plans section.

Step 5: If you have not already uploaded your floor plan, click the "Upload a Floor Plan" button.  Select the floor plan and begin the upload.

Step 6: Once the upload is complete, click on the floor plan image.

Step 7: On the right-hand side, you will see photo hot spots that have been created from the images that you uploaded into the Site Media page.  Drag and drop a hot spot onto the floor plan for the corresponding room.  Note: each hot spot can only be used once.  When a hot spot is grayed out, that means it is already being used.

Step 8: Once you are done adding your hot spots, click the left or right arrow to be taken back to the Site Media page.

When adding your media to a property website, you have the option to embed media.  Some examples of items that can be embedded are a property walkthrough video or a 3D floor plan. Embedding the media allows you to separate some of your media items and also includes these in the navigation of the property website, making it easier for viewers to see!  Take a look below on how you can utilize these sections on your property website.

Step-by-step:

Step 1: Go to the Site Summary for the property.  You can get there by clicking the Sites tab at the top of the page and searching the property address.  Once you click on the property, you will be taken to the Site Summary.

Step 2: Click the Site Media tab on the left-hand side of the page.

Step 3: Scroll down to the bottom of the page where you will see the Embedded Media sections, Upper and Lower.  Note: The difference between the two sections is that Upper will appear just above the property description on the property website and Lower will appear just below the property description.  

Step 4: Click the "Add Embedded Media" button in your desired section.  You will get a small pop-up window. 

Step 5: In the "Name" box, enter in a name for your media.  This could be something like "Branded Video" or "Unbranded 3D Floor Plan".

Step 6: In the Embeddable URL box, enter in the URL for the media that you would like to add.  This could be a Vimeo or Matterport link.  If you have uploaded a video file to the Site Media already, you will see a "Content to Embed" drop-down.  If you click that, you can switch from the Web Page URL option to the video that is in the Site Media. Note: choosing an existing uploaded video will also prompt us to generate a Vimeo link.  This could save you time since you won't have to upload to Vimeo then use that url in the Embedded Media section.   

Step 7: Once you have entered in your URL, you will have the option to choose which site pages you would like that displayed on.  In the Display On area, you can choose to display your media on the Branded Property Site, the Unbranded Property Site, the Marketing Kit Page/Download Page/Delivery Email or all three.  Note: this is extremely helpful when you have a branded video that you won't want to be displayed on the unbranded property site!

Step 8: Click the "Ok" button to save your changes and embed your media to the property website! 

You will find your links and marketing materials under the Marketing Kit tab in your account. Use the link on the completion email or login to your account to access your Marketing Kit.

Your social media marketing materials can be found under the Marketing Kit tab in your account. You will need to login to your account or access the Marketing Kit using the link on the delivery email, Total Marketing Kit link. You will have access to customize all of the social tiles for your marketing needs. There are 28 styles to select from with more coming all the time. 

Log in to your account and go to the Marketing Kit tab. Go to the section Social Media Flyer Tiles. Select the tile you would like to edit by clicking the Edit Button.

Step 1: From the Sites tab at the top of the page, click the property that you would like to access the social tiles for.  This will take you to the Site Summary page.

Step 2: Click the Marketing Kit tab on the left-hand side.

Step 3: Scroll down to the Social Media Flyer Tiles section.

Step 4: Choose the social tile to fit your needs; Just Listed, This Won't Last Long, New Listing, Open House, Sold, Get Creative, Facebook, or Pinterest.  Click the "Edit" button for your desired tile.  Note: the Facebook and Pinterest social tiles are optimized for use on those specific platforms, however, you can still use any of the other tiles that you would like on either of those platforms.

Step 5: Depending on the social tile that you have selected, you can make changes to most of the Social Media Tile Details to really customize it for you and your client.  These include the headline, address, photo, fonts, colors, and agent information.

Step 6: Once you have made your changes, click the "Save Updates" button.

Step 7: Then, click the "Download" button for that social tile to save it to your device.  From there, you can share it on your various social media platforms.

With our Visual Media Editor, you can create custom Social Tiles for your clients!  You have the ability to create custom social tiles for all of your clients or even an exclusive social tile for a specific client or group.  These custom social tiles will appear with the default tiles on the Marketing Kit page.  Your client will also still be able to make additional edits to the custom social tiles if they need to!  Take a look below at how to create a custom social tile!

How to create a custom social tile design

    Step 1: Click the Business tab

    Step 3: Scroll to Custom Social Tile Designs section

    Step 4: Choose desired tile size

    Step 5: Click the 'Photo' button

    Step 6: Adjust photo size and position

    Step 7: Click the Heading or Text button

    Step 9: Click 'Shapes' button

    Step 10: Add desired shapes

    Step 11: Choose a tile Name and Group/Client exclusives

    Step 12: Switch to 'Active' and click 'Save & Close'

Step-by-step:

Step 1: Click the Business tab at the top of the page.

Step 2: Click the Custom Designs tab on the left-hand side of the page.

Step 3: Scroll down to the Custom Social Tile Designs section at the bottom of the page.

Step 4: When creating a custom Social Tile, you are provided 3 different size options.  You can choose from Landscape, Square, or Portrait formats.  Click your desired social tile size.

Step 5: Once you choose your desired tile size, you will be taken to the Visual Media Editor.  From here, you can add different elements to your social tile.  On the left-hand side, you will see the 'Add an item' menu.  Click the 'Photo' button to add an image box.

Step 6: Once the photo box is added, you can adjust the size and placement of the box on your social tile.

Step 7: Once you are happy with your image placement, you can add a Heading to Text box to include verbiage on your social tile.

Step 8: Once your Heading or Text box is added, you can add your verbiage and adjust the font, color, position, etc.

Step 9: If you click the 'Shapes' button, you will see various shapes and symbols that can be added to your social tile.

Step 10: From basic shapes to symbols indicating bedrooms/bathrooms in a home - there are many options that you can include on your custom social tile!

Step 11: Once you are satisfied with your custom social tile, you can name your tile and set a Group or Client exclusive.  Note: if you only want to offer this social tile to a specific group or client, being typing their name in the corresponding box and choose them from the populated list.  Once you make this social tile active, it will only be visible to those select users.

Step 12: If you are ready to allow clients to start using this social tile, switch the status to 'Active' and click 'Save & Close'.  Clients will now be able to use your custom social tile on their properties!

You can choose which image you would like displayed when your property website link is shared on social media!  By "starring" a social tile, you can make that tile the one displayed any time the link is shared.

Step 1: From the Sites tab at the top of the page, click the property that you would like to set a share image for.  Note: you can also set a default share image for your client.  Click here to find out how!

Step 2: Click on the Marketing Kit tab on the left-hand side.

Step 3: Scroll down to the Social Media Flyer Tiles section.

Step 4: Find the social tile that you would like to display when sharing the link to social media.  Click the star in the upper left-hand corner of the social tile image.

Step 5: Share the link to your social media pages and see that social tile appear as the share image.

The sit videos created from the still photos are limited to:

1) 33 images for the Social Media teaser videos

2) 50 images for the slide show videos

To select the photos you want to display in the videos you must select the star at the bottom of the photo. Otherwise the system will default to selecting the first 33 photos for social teasers and the first 50 for the slideshows.

Step-by-step:

Step 1: From the Sites tab at the top of the page, click the property that you would like to share to social media.  That will take you to the Site Summary page.

Step 2: Click the Site Activation tab on the left-hand side of the page.

Step 3: Scroll down to the Social Media section.  You will see the various social media platforms that you can share to. 

Step 4: Click the "Share" button for the platform that you would like to post to. Note: You can also Preview or Download where available. 

Step 5: If you are not already logged in, you will be prompted to log in to create your post.

Step 6: At this point, you can make any changes to the post if you need to.

Step 7: Once you complete the post, it will appear on that social media platform for you.

Step 1: From the Sites tab at the top of the page, click the property that you would like to access the Site Videos for.  This will take you to the Site Summary page.

Step 2: Click on the Marketing Tab on the left-hand side of the page.

Step 3: Scroll down to the Site Videos section to see the Teaser, Branded, and Unbranded videos. 

Step 4: If you need to make any changes to the video, click the "Edit" button.  Make your changes and then click "Save Updates".

Step 1: To add or edit a flyer for a property, you will first want to go to the Site Summary for that property.  From the Sites tab at the top of the page, you can search for the property.  If you click on the property from the search results, you will be taken to the Site Summary page.

Step 2: From there, you will click the Print Materials tab on the left-hand side of the page.

Step 3: If you do not already have a flyer created for this property, you can click the 'Choose another flyer template' box to add a flyer.

Step 4: Choose the flyer template that you or your client like the best. Note: if you already have a flyer created for a specific template name, it will no longer appear when adding a new flyer.  You will need to edit the existing template that has already been created.

Step 5: Once you have selected your template, the flyer editor will automatically open for you.  The flyer will prepopulate with the images that have been uploaded on Site Media. If you need to swap out any images, you can drag/drop images from the right-hand side to where you would like that image on the flyer.  Note: the client headshot and logo will also be included on the right-hand side with the property images.

Step 6: If needed, you can modify an image by clicking on that image box.  Once you click on an image, you will see editing tools displayed across the top of the editor.  

    Edit Image - Allows you to make slight modifications to the image such as brightness or contrast

    Crop - Allows you to crop the image

    Fit - Allows you to reposition the image

    Flip - Allows you to flip the image horizontally or vertically

    Stroke - Creates an image border

Step 7: If needed, you can modify the verbiage in any existing text box by simply clicking on the text.  Once you click on the text box, you will see text editing tools across the top of the flyer editor.  Some of the things you can edit are font, size, color, alignment, or even delete a text box altogether.  

Step 8: On the left-hand side of the editor, you will see items that you can add to the flyer.  If you click 'Photo', that will add a photo box to the flyer.  One way to use this would be if you or your client chose a flyer that didn't include the client logo, you can add an image box and then drag/drop their logo from the right-hand side and into that photo box.

Step 9: On the left, you can click 'Heading' to add a heading text box to the flyer.  An example where this would be used is if your client would like to add a "Just Listed" or "Vacation Rental" type banner to the flyer.

Step 10: If you find that you need an additional text box, you can add one by clicking 'Text' on the left-hand side of the editor.  This can be used to add the property description, amenities, or even brokerage info.

Step 11: The 'Shape' button on the left-hand side will allow you to add some basic shapes to your flyer.  These shapes also include the Realtor and Equal Housing logos.

Step 12: Once you have made all of your desired changes, be sure to click the 'Save & Close' button in the upper right-hand side of the editor.  This will take you back to the Print Materials page where you can add additional flyers or print/save the flyer that you just created.  Note: if you click 'Cancel' then any changes made will not be saved.

Step-by-step:

Step 1: Click the Business tab at the top of the page.

Step 2: Click the Custom Designs tab on the left-hand side of the page.

Step 3: On this page, you will see your Custom Site Designs, Custom Flyer Designs, and Custom Social Tile Designs.  In the Custom Flyer Designs section, click the 'New Flyer' button for the site of flyer you would like to create.  Note: you can also create a custom design based on one of our existing templates.  This option will allow you to make custom modifications without having to start from scratch.

Step 4: You will now see the custom flyer creator.  At the top of the editor, choose a Meld Name for your custom flyer design.  This name will be visible by your clients.

Step 5: In the Co-Listing drop-down, you can choose whether you want the co-list client to be displayed on the flyer.  You can choose 'Not Offered' - won't display at all, 'Optional' - allow the client to choose whether to display or not, or 'Required' - will always display the co-list client.  

Step 6: If you would like to make this flyer template exclusive to a specific Group, you can type that group name in the Group box and choose the group once it is shown.  This will prevent anyone from outside that Group to use this custom flyer template.  This is especially helpful if you are creating a flyer template using custom brokerage colors!

Step 7: If you are creating this flyer template for a specific client, you can type that client's name in the Client box and choose them once shown in the results.  This will only allow that one client to use this custom flyer template.

Step 8: In the 'Add an Item' left-hand menu, click the 'Photo' button to add an image box.  Your clients will be able to drag/drop their site images into these boxes.  Once the image box is added, you can resize it and adjust it to anywhere on the flyer design that you would like. Note: You can the Media Type of a Photo box so that it will auto-populate accordingly.  For example, you can set the Media Type as 'Client' so that the client's headshot will auto-populate onto the flyer.

Step 9: Next, you can add a Heading text box.  Once the Heading text box is added, you can adjust the size of the box.  You can also adjust the font, font size, font color, and alignment.

Step 10: You can also add Text boxes for things like amenities, a property description, or the client information.  Much like the Heading text box, you can adjust the size of the box and make changes to the font.

Step 11: To make some items stand out, you can also add Shapes to your flyer template.  The color and size of the shapes can be modified.  Note: the Realtor and Equal Housing logos are included in the Shapes options.  

Step 12: Once you are satisfied with your flyer template, you will switch the Status to Active.  This will make your flyer visible to your clients (or exclusive Group/Client) and they will be able to use it for any of their property sites.  Note: your flyer template will not be saved until you click 'Save & Close'.

Step 13: Click the 'Save & Close' button to return to the Custom Designs page.  Note: you can click 'Save' at any time to ensure that your changes are saved along the way.

Step-by-step guide to create your listing page:

Step 1: You will first want to access the client account that you are creating the Listings Page for.  You can do this by clicking the Clients tab at the top of the page, searching for the client, clicking their name, and then clicking the "Access Account" button.

Step 2: Once you are logged in as your client, click the Account tab at the top of the page.

Step 3: Click the Listing Pages tab on the left-hand side of the page.

Step 4: Click the "Create a New Listings Page" button to create a new page.  Note: you can sell this as an additional service that you provide, however, your clients do have the ability to create Listings Pages on their own.

Step 5: The first option you have for the new Listing Page is the type of page you would like to use.  Click the pencil/paper icon to change the page type.  The 'Embed' options are just the property sites.  This would allow your client to simply embed this on their existing website.  The 'Page' options appear as their own webpage with headers/footers.  Lastly, the 'Enhanced' option has more customization available such as a media player and additional branding.

Step 6: If needed, you can change the Listing Page URL by clicking the pencil/paper icon to the right of the existing URL.

Step 7: For additional edits, click the "Customize" button.

Step 8: In the Config section, you can make changes to the design settings.  You can use your client's preferred fonts/colors and upload an image that will be displayed when the client shares their Listing Page URL to social media.

Step 9: In the Property Sites section, you are able to choose what properties you would like displayed and how you would like they displayed.  

Step 10: Once you have made all of your changes, click "OK".  Note: changes can be made to the page at any time.  

Step 11: Now, you can switch the page status to "Active" and it will be visible to the public.  Note: you can also include this page as your client's inventory link on their property websites.  Click here to see how!

If you have placed the unbranded tour link in the MLS, It will syndicate to third party sites like Zillow, Trulia, REALTOR.com, Homes.com and also to independent brokerage sites using IDX to provide listings data on their sites.

No. We do photography and video only. The property should be ready when we arrive. We recommend the agent walk the property 30 minutes before the shoot with the owner to ensure everything is staged for the shoot. Please keep in mind that the photographer also can not wait for items to be moved from room to room for photos.

Correct Placement of Company, Agent and Seller Branding on MLS Listings

The “Canopy MLS Rules and Regulations” (Section 1.7) says “Branding” is prohibited in the “Public Fields” of a listing defined as fields provided on the Customer Report, Client Portal, and distributed in the IDX data feed, including but not limited to Photos, Photo Captions, Virtual Tours (and videos), Directions, Public Remarks, Restrictions (Lots/Acres/Farms, and Commercial).

“Branding” is defined as any information that might lead a consumer directly back to the listing agent, Listing Brokerage or Seller, including but not limited to:

• Phone numbers
• E-mail addresses
• Websites that give reference to the listing agent, Listing Brokerage or Seller
• Company and/or personal names
• “For-sale” signs (excluding signs required by neighborhood restrictions if the text of the sign is illegible)
• Logos
• Slogans
• Recorded sound that gives reference to the listing agent, Listing Brokerage or Seller
• Theme songs

Including company, agent or seller contact information in the fields that appear on the Customer Report could be construed as communicating directly with the buyer agent’s client, jeopardizing the buyer agency relationship.
In addition, Public Fields cannot include content such as:

• Any reference to commission, compensation, referral fees or incentive offered to a buyer’s agent;
• Any reference to a scheduled open house, model open, sales office open or to a TV showing of the property; or
• Instructions to place offers on eBay or other auction websites.

When a listing is found in violation, the listing agent is notified by email to correct the listing. If not corrected within two business days, a $100 fine is issued. Additional violations carry increased fines.

Permitted

• Websites that do not display listing agent, firm or seller/builder branding.
• “For sale” signs required by neighborhood restrictions if the text of the sign is illegible.
• Subdivision plat maps or floor plans if there is no reference to the listing agent, firm or seller/builder.
• Special promotions for financing, bonuses and incentives if there is no reference to the listing agent, firm or seller/builder.
• Phone numbers to verify information such as school assignment.
• The basic (free) versions of YouTube, Vimeo or other websites (or apps) can be used for unbranded virtual tours. However the comments, messages and other methods of communication must be disabled as much as possible depending upon the settings provided for each site. The websites or apps cannot provide any seller, listing agent or brokerage firm branding.
• An agent’s face can be seen and voice can be heard in an unbranded virtual tour.

Prohibited

• Bank-owned and auction website addresses such as www.ocwen.com, www.realtybid.com and www.bidselect.com which allow consumers to bid on properties directly without using a Realtor®.
• References to www.carolinahome.com because CarolinaHome.com displays the listing agent name and contact information.
• ALL graphics such as logos or messages superimposed onto the photo. The media portion of the listing is intended for photos or renderings of the property ONLY.
• Company or agent “for sale” signs. Although the contact information may not be discernable, the shape or color of the sign may reveal the listing company.
• Documents such as property disclosure statements or fliers, etc. which may display the listing agent, firm or seller/builder name. These documents may be attached to the listing as a PDF or text file, which are not included with the Customer Report.
• The Virtual Tour Universal Resource Locator (“URL”) may not contain any characters within the URL which could identify or direct a user back to the listing agent, Listing Brokerage or Seller’s website, or any “favicon” resembling the listing agent, Listing Brokerage or Seller logo. Virtual tours and videos may not contain Branding other than the virtual tour vendor’s name, and if the listing agent or Listing Brokerage is the virtual tour vendor, the name of the listing agent or Listing Brokerage cannot be included.

Note: Website links, text files, and PDF files uploaded attached to listings in the MLS system do not appear on the Customer Report or Client Portal, and are not distributed in the IDX data feed. Branded virtual tours and Syndication Remarks also do not appear on the Customer Report or Client Portal, but are provided in the IDX data feed even though they are not required to be displayed.

Virtual Staging

“Virtual Staging” is defined as using photo editing software to create a photo or conceptual rendering of what a room and/or property could look like, if it were staged or lived in. (Section 1.22.1 of the Canopy MLS Rules and Regulations)
 

1. Prohibited Inclusions: Modifying photo(s)/rendering(s) to include visual elements not within a property owner’s control is strictly prohibited. Example: Editing in a view of the Charlotte skyline or football stadium that is not physically possible from the specified location in the real world.
2. Prohibited Exclusions: Modifying photo(s)/rendering(s) to exclude visual elements not within a property owner’s control is strictly prohibited. Example: Removing power lines, water towers and/or nearby highways.
3. Permitted Uses: Modifying photo(s)/rendering(s) to include personal property items not conveyed with the real property is permitted. Permitted personal property modifications include, but are not limited to:
   • Applying digital photos of furniture, mirrors, artwork, plants, etc. into a photo of an empty room.
   • Removing existing furniture from a photo and replacing it with digital images of furniture, mirrors, artwork, plants, etc. 
   Disclosure of virtually-staged photo(s) is required to be readily visible on the image, and a non-staged image must be included immediately following or preceding the virtually-staged photo(s).
4. Permitted Virtual Staging and Listings of Properties Not Fully Constructed: Virtually-staged photo(s)/rendering(s) on either (a) To-Be Built or (b) Under Construction is permitted for all facets of real property to be conveyed to a buyer in a sale. Disclosure of virtually-staged photo(s)/rendering(s) is required on the image.

If the weather is bad on the day of your scheduled shoot (i.e. rain, high winds, thunderstorms, and the like) you will be given the opportunity to reschedule for the next available open shoot date.  In some severe weather conditions, we cannot risk damage to the camera equipment and will not be able to shoot regardless. In those instances, your shoot may be rescheduled for our next available opening.

Drones can not fly in rain or in high winds above 25 mph at 100 feet. 

We only want our clients to think warm and fuzzy thoughts about us and fee policies like this don't really do that - but we do have to pay our photographers when we reserve their time. When you schedule services with us, you are reserving a valuable time slot that will not be available to others. When you cancel or reschedule the same day as your photo shoot, we have to pay our photographers for that reserved time. 

While everyone understands the purpose of cancellation fees and agrees to the terms of service, nobody likes paying them. So we do our very best to keep you apprised about your upcoming appointment. We suggest you confirm the appointment with your client 48 hours before the scheduled shoot. As soon as you become aware that the property is not ready as scheduled, call Mark Jacobs Productions at 704-230-1033 and/or email mjacobsproductions@icloud.com so we can notify the photographer and either remove it from the schedule or set up a new appointment time. 

* If you cancel or reschedule the appointment with less than 24 hours' notice, then you agree to pay a reschedule/cancellation fee of $50. 

* In the event that the photographer arrives at the shoot and cannot access the home or it is not ready to shoot, then you agree to pay a fee of $100 unable to shoot fee. 

Refunds:  I understand that deals are always changing. If you need to cancel a scheduled shoot without rescheduling, I will refund your full amount with 24 hours notice for all prepaid services to your credit card. For refunds with less than 25 notice, a $50 cancellation fee will be charged. Just email or call me and we'll work it out. It takes 5 to 10 business days for the credit to show in your account.

It is the client's responsibility to ensure that the listing is ready for the virtual tour to be produced at the arranged time. Mark Jacobs Productions doesn't handle any cleaning, dusting, or moving of furniture for liability reasons! 

At the shoot If possible, you or someone you authorize should be present to discuss important elements of the property, or areas that should not be photographed. However, the photographer can work independently if needed. The photographer will make a reasonable effort to remove stray objects from the rooms; however please note that this does not include moving or rearrange furniture, making beds, clean, dust or de-clutter, picking up toys or yard items, touch personal bathroom supplies (shampoo, toothbrushes, deodorant, towels). Agents are expected to have the property staging and cleaning completed prior to the photoshoot. Our goal is to provide quality digital images. Including exterior front and rear shots, one or more views of each major room, and views of the yard and/or views from the property, if any. Your input is important when choosing the best rooms and angles to photograph. Absent your input, the photographer will use his/her best judgment and experience to decide how best to photograph the property. 

Photographers will do their best that all significant aspects of the property shall be included in the tour unless the condition of said aspect has a negative impact on the tour. This shall be left solely up to the photographer's discretion unless specific aspect(s) of the property is requested by the agent or the homeowner on the order form or at the shoot. 

Once the home has been photographed or video shot, the service may not be canceled. The agent will be charged the full price of the package ordered. In addition, the photographer will not retouch images in order to disguise any known defects and/or physical structures such as cracks in walls or driveways, power-lines, water towers, etc. 

The agent has 72 hours from receipt of photos to request a re-shoot. Mark Jacobs Productions will re-shoot up to 5 images due to poor image quality or poor image composition at no charge at our next opportunity. We will make every effort to make it ASAP. Poor images due to weather conditions, property condition, or the property not being prepared/staged for the shoot are not eligible for free re-shoot. If the agent would like a re-shoot there will be an additional charge.

The listing agent must be present at re-shooting (no exceptions) and approve the images before the photographer leaves the property. Canceled appointments with less than 24-hour notice are subject to a $50 fee. Arriving late beyond 30 minutes to an appointment will be considered a cancellation, and will be billed at the full rate of the shoot.

Drone images and Video media are not eligible for free re-shoots. If the agent would like a re-shoot of drone media there will an additional charge. 

Mark Jacobs Productions grants you a non-exclusive, non-transferable, limited right to access, view, use, display and print information on the Mark Jacobs Productions site, including all the materials provided hereon, for your personal, informational, property marketing use only. You may not copy, modify, reproduce, create derivative works, distribute, transmit, license, or sell any content or any portion of the Mark Jacobs production site without the prior written consent of Mark Jacobs Productions. Generally, Mark Jacobs Production will grant permission for such use so long as Mark Jacobs Productions is properly acknowledged, but the prior express written consent of Mark Jacobs Productions is required. 

All images and media ("Content") created by Mark Jacobs Productions is the sole property of Mark Jacobs Productions. Mark Jacobs Productions retains ownership and licensing rights to all photos, videos, and all other tour content. Content is made available to clients for property-specific marketing purposes only, for a term of 1 year. Any publication of content for non-specific property marketing purposes is strictly prohibited by law without the express written consent of Mark Jacobs Productions. All images and media (“Content’) created by Mark Jacobs Productions are copyright protected.

Mark Jacobs Productions respects copyright law and expects you to do the same. Unauthorized copying, distribution, modification, public display, or public performance of copyrighted works is an infringement of the copyright holders' rights. As a condition to your use of the Service, or your use of the site, you agree that you will not use the Site or Service to infringe the intellectual property rights of others in any way. Mark Jacobs Productions policy is to terminate access to the site and use of the Service by any users who are repeat infringers of the copyrights or other intellectual property rights of others. 

The photographs and videos taken by Mark Jacobs Productions are licensed to the agent who paid for the service for a one-time, non-exclusive commercial use for the marketing of the given property for the term of 1 year. Images may be used in any manner related only to the sale of the given property under the agent who originally purchased the services. The photos may no longer be used or license transferred in any way after the listing has closed, expired, withdrawn, re-listed with another agent, or the listing is withdrawn and re-listed by another agent in another firm without the written permission of Mark Jacobs Productions. Images cannot be sold to another agent or firm who takes over an expired or withdrawn listing. Photos cannot be sold to a third party for any reason. 

As experienced photographers, we deal with copyright on a regular basis. But we sometimes assume our clients know just as much about copyright, image use, and licensing as we do...and that's a wrong assumption on our part.

In consideration of (Customer's/Real Estate Professional's) payment of photographer's/artist’s/architect’s) fee for creating, preparing and delivering the (photographs/drawings/renderings) to (Customer/Real Estate Professional), (Photographer/Artist/Architect) grants to (Customer/Real Estate Professional) a license to use the (photograph/drawing/rendering) in the (Customer/Real Estate Professional) (Board’s/MLS’s) compilations of properties (current and sold) and in real estate related advertising, brochures and other promotional materials, including the right to reproduce, create derivative works from, distribute, and publicly display the (photograph/drawing/rendering) in print, on the Internet and otherwise. The photographer will retain all copyrights, but the agent may purchase the copyrights for an additional fee.
